Is it more appropriate to adopt the Hanbali view that divorce occurs for one who falsely admits to it, or the view of the majority that it does not occur, given the contradiction between the two statements and the hardship that results from this?

A Muslim acts, in matters where scholars have differed, according to what he predominantly believes to be the truth. This is either by examining the evidence and acting upon the strongest, if he is capable, or by imitating the most trustworthy opinion if he is not qualified. If the opinions are equally weighted, Sheikh Ibn Uthaymeen (may Allah have mercy on him) was of the view that the most preponderant course is to follow the easier option, because it aligns with the words of Allah the Almighty: (Allah intends for you ease and does not intend for you hardship).
