Is one who adopts the opinion of those who do not obligate the Fidyah for delaying the making up of fasts without an excuse due to lack of income considered sinful?

The majority of scholars have made it obligatory to offer fidyah (expiatory feeding) along with making up the missed fasts for anyone who delays making up a Ramadan fast until the next Ramadan begins without a valid excuse. The fidyah is estimated as one mudd (a measure) of food for each day. However, the Hanafis and some Shafi'is are of the opinion that it is not obligatory. While the view that fidyah is obligatory is strong, there is no blame upon one who acts according to the other opinion if they are qualified to weigh scholarly opinions or to follow a particular school of thought. It is not permissible to adopt this opinion merely out of personal desire.

As for not having an income, this does not waive the fidyah. Rather, it remains a debt upon the poor person until they are able to afford it, because the reason for its obligation is the delay itself.
