The client is obliged to guarantee what he has taken in excess of his right, for the excess is a trust in his possession. The trustee guarantees the trust if he thought it was his and then consumed it or dropped it. The reasons for guarantee are three: direct destruction, causing damage, or seizing it without being entrusted.
