What is the Sharīʿah ruling concerning a man who divorced his wife eight times, yet refuses to return her daughters to her, despite there being neglect, mistreatment, and molestation inflicted upon the girls, and he claims that the divorce did not occur? Is his wife lawful to him after these repeated divorces? And how can the divorce be proven and custody regained in the absence of witnesses?

Such a matter cannot be decided except by the court after hearing both parties and their evidence and arguments. For the ruling concerning a husband who divorces his wife and then denies the divorce, please refer to Fatwa No. 46278. For the custody of daughters, who has the most right to it, when its duration ends, and whether the father can prevent the mother from seeing her daughters, please refer to the following Fatwas: 32860, 34286, 59334, 78463.
