Do the sons of brothers and the sons of sisters deserve a legitimate share of the inheritance of a man who passed away, leaving behind a wife and a minor daughter, knowing that all of his brothers, sisters, and parents had passed away before him?

The deceased man's estate is divided as follows: The wife receives one-eighth due to the presence of a lineal descendant, based on Allah Almighty's saying: ﴿But if you have a child, then for them [the wives] is one-eighth of what you leave.﴾ And the daughter receives one-half because she is alone, based on Allah Almighty's saying: ﴿And if there is only one, she will have half.﴾ The remainder goes to the closest male agnate (asabah), who are the nephews (sons of the brother), based on the Prophet's (peace be upon him) saying: "Give the prescribed shares to those entitled to them; then whatever remains is for the closest male relative." The original denominator of the estate is eight: four for the daughter, one for the wife, and three for the agnates.
