The question

What is the Sharia ruling regarding a definitive divorce (طلاق بائن) occurring after the husband swore an oath to divorce his wife if she plucked her eyebrows (al-nams), and is reconciliation (rajʿa) valid if the first (divorce) was an internal intention not known to the wife, and the second occurred during the wife’s third menstrual period? And what is your advice for dealing with a wife who is remiss in religious matters?

The answer

"Reconciliation (Ar-Raj'ah) is the restoration of a revocably divorced woman to her previous state without a new contract. It is only valid after a divorce and cannot be made conditional. The waiting period (iddah) for a revocably divorced woman who menstruates is three menstrual cycles (haydhat), based on the Almighty's saying: (وَالْمُطَلَّقَاتُ يَتَرَبَّصْنَ بِأَنْفُسِهِنَّ ثَلَاثَةَ قُرُوءٍ) 'And divorced women shall wait by themselves for three periods (quru').' The term 'qur'' refers to menstruation. If the third menstruation ends and she performs ghusl (ritual bath), her waiting period is concluded. If the husband has sexual intercourse with his wife during the waiting period, some jurists consider his intercourse a reconciliation, even if he was unaware of the divorce having occurred."
