Is slaughter obligatory in voluntary Hajj, and for whom is the slaughter, for the deceased or for the person performing the voluntary Hajj?
The sacrificial animal (hady) is obligatory for one who performs Hajj al-Tamattu' or Hajj al-Qiran on behalf of a deceased person. The jurists have differed on whether the hady is incumbent upon the pilgrim (the one performing Hajj) or upon the person for whom Hajj is performed (the deceased).
The Hanafis, Malikis, and according to one view that is not the most authoritative among the Shafi'is, held that it is incumbent upon the pilgrim (the one commanded to perform Hajj). The Hanbalis and the most authoritative view among the Shafi'is held that it is incumbent upon the person for whom Hajj is performed (the one who issued the command).
If the representative performed Hajj al-Tamattu' or Hajj al-Qiran on behalf of the deceased at the latter's command before death, then the blood (sacrifice) for Tamattu' and Qiran is taken from the wealth of the person for whom Hajj was performed. If the representative performed Hajj on their own initiative, then the blood (sacrifice) for Tamattu' and Qiran is from their own wealth. However, any blood (sacrifice) necessitated by a transgression (during Hajj) is incumbent upon the representative.
