How is the act of parents who commit a grave sin or incite it described, and what is the ruling concerning the father in the aforementioned case, based on previous fatwas? Do the measures taken by the father to restore rights constitute a will, or do they fall under another concept? And what are the consequences for the younger brother who obeyed his father in depriving his brother of inheritance?
We draw attention to the fact that Fatwa no. 87354 relates to withholding financial support from the wife and tarnishing her image before the children.
Regarding the subject of your question, we are forbidden from describing what your mother did as an act of Satan, because Allah commanded children to speak kindly to their parents, and this was not conditioned on the parents being in the right.
We have issued a fatwa to you stating that what your father did is considered to be in the ruling of bequests (وصايا), and cannot be considered an inheritance (تركة), because it is not valid except after the death of the bequeather. Nor is it a gift (هبة), because one of the conditions for the completion of a gift is that it must be taken possession of before the death of the giver, and it appears that these properties were not taken possession of. Therefore, all that your father left behind is considered an inheritance to be divided between you and the rest of the heirs according to the prescribed legal shares. This applies equally to what was written in the names of your siblings, or in your name, or your mother's name, that was not taken possession of during the father's lifetime.
Even if it were assumed that you were wronged and that the procedures were gifts and some heirs took possession of them, our preferred opinion is that this would be reversed and not acted upon, because it is unjust. Accordingly, what is to be upheld from what was taken possession of is what was gifted to the mother, but what was gifted to the children is to be returned to the estate.
