Can a judge divorce a wife, or would it be a Khul', if the wife possesses a recording of her husband talking to a girl and asking her for money to go out with him or visit him at home, knowing that the husband constantly talks to girls and does not accept his wife's advice?

It is not permissible to spy on the husband, or to seek out his private matters, or to eavesdrop on him, due to the Almighty’s saying: "And do not spy," and the Prophet, peace and blessings be upon him, said: "Do not spy, nor inquire, nor hate each another; and be brothers." One must repent from this sin. If the husband reveals illicit relationships with women, then one must try to save him and preserve the family. If advice does not work, it is permissible to seek a divorce due to the corruption of his religious commitment. This is done by raising the matter to the judge or through a mutually agreed-upon khul'. It is advised not to rush this decision.
