The marriage contract with a minor is valid according to the majority of scholars, with a few dissenting opinions. Some contemporary scholars have chosen to disallow the marriage of a minor unless she gives permission after nine years of age, or if she has reached puberty. The criterion for the validity of marrying a minor is the benefit (maslaha); if this benefit is absent, the contract is nullified.

Regarding the issue of intercourse with or consummating the marriage with a minor: Intercourse with a minor is forbidden if she cannot tolerate it. This is the opinion of the majority of jurists.
