Scholars have agreed that the sanctity of a grave remains as long as there is any part of the deceased in it. Therefore, it is not permissible to exhume it or walk on it. However, if it has disintegrated and turned into dust, it is permissible to exhume it, walk on it, and utilize its land for planting, cultivating, and building. This relies on the expertise of specialists. So, if the cemetery you live near has completely disintegrated and turned to dust, it is permissible for you to drive over it. Otherwise, it is not. You may only cross it on foot, as the Messenger of Allah, peace and blessings be upon him, forbade sitting on graves.
