What is the religious ruling on distributing the estate of a mother who passed away and left 40,000 Egyptian pounds, having four living sons and one daughter who passed away before her and who herself has two daughters? What is the share of the living sons, and what is the share of the two daughters of the deceased daughter? Do the siblings of the deceased sister inherit her share of the obligatory bequest?

The fatwa was issued based on the "obligatory bequest" law, which is not supported by the Qur'an, Sunnah, or the sayings of early jurists. Rather, it is an independent legal reasoning (ijtihad) that no one has previously advocated, and it obliges giving a portion of the inheritance to a non-heir. This was opposed by prominent scholars, such as Sheikh Ibn Baz, who considered it contrary to the law of Allah. Therefore, the two granddaughters have no right to this money except with the consent of the heirs. If the heirs are unable to re-divide the inheritance, they should be patient and seek their reward from Allah.
