Is it permissible to annul a legitimate Islamic marriage contract with a man who is not religious, abandons prayer, and drinks alcohol, before consummation and before setting the wedding date and paying the dowry, due to a lack of desire for him and a desire to marry another man who is religious and of good character? And is it sufficient to inform the husband of the lack of desire to complete the marriage without him uttering the divorce pronouncement?

If it is established that the young man reviled the religion and did not repent before the marriage contract, then the contract is invalid. However, if he reviled the religion after the contract, then the contract is annulled by his apostasy. The annulment of the contract depends on the establishment of the husband's apostasy, and the contract must be annulled by a judge or someone acting on his behalf, or by divorcing him, or by ruling him an apostate.
