Is it permissible to annul a marriage contract from a man (the husband) who is unaware of his wife's loss of virginity, for the purpose of marrying another man (the beloved) who is aware of it and who had proposed to her but was rejected on the pretext of his delay, knowing that the current husband is not religiously committed, while the beloved is committed and advised her to be religious, and is it possible that she was born without a hymen?
What transpires from the acquaintance between young men and women and love relationships is a gate to evil and corruption, because it contradicts the guidance of Islam, which protected women and preserved their dignity, and legislated legal marriage as the path for relationships between men and women. The duty is to repent from prohibitions by abandoning the sin, regretting it, and resolving not to return to it.
It is not permissible to seek divorce or khul' from the husband for the desire to marry someone else, due to the Prophet, peace and blessings be upon him, saying: "Any woman who asks her husband for divorce without any sound reason, the fragrance of Paradise will be forbidden to her," and his saying: "The women who seek khul' are the hypocrites." It is permissible for a woman to seek divorce if the husband is oppressive or immoral.
The fact that the husband was neglecting prayer and abusing drugs does not justify seeking divorce if he has repented, for the consideration is his present state, not his past. The loss of virginity does not justify seeking divorce.
It is not permissible to seek annulment of the marriage contract merely for the desire for another person or for the husband's past immorality. If it becomes clear that the husband is still immoral, then you have the right to seek divorce due to his immorality. Fearing Allah and relying on Him is sufficient for every worry.
