Is it obligatory to obtain a decree from the court, or is witnessing sufficient to complete the revocable return (rajʿah) after a single divorce? And is the wife considered disobedient (nashiz) for refusing cohabitation and treatment? And is the husband entitled to withhold maintenance from her while she is in her family's home? And is she allowed to stipulate conditions for the revocable return? And does the husband incur sin for divorcing her while she is psychologically ill?

First: For the validity of the rajʿah (revocation of divorce), it is not a condition to prove it in the Sharia court. Rather, it is sufficient for two upright witnesses to attest to it. However, if the initial divorce was registered in court, then the rajʿah should be registered there to correct the official records.

Second: If the psychological illness that afflicted the wife affected her awareness and intellect such that she could not control her actions, then she is not considered nashiz (recalcitrant) or disobedient, because the basis of legal accountability (taklif) is intellect. However, if she was in control of her actions and it was merely a mild depression, then she would be considered nashiz by her departure and refusal of the marital bed, and in that case, the husband is permitted to withhold her maintenance.

Third: The wife is not permitted to impose specific conditions for the rajʿah, because it is an exclusive right of the husband, and her consent or the consent of her guardian is not required for it.

Fourth: What you are experiencing is a trial from Allah, and you should be patient and supplicate to Him. Your patience with your wife and helping her overcome her ordeal is better for you and brings reward. If patience becomes too difficult for you and you divorce her, there is no sin upon you. However, the better course is patience and giving her another chance, perhaps Allah will facilitate her healing.
