What is the ruling on breaking an oath in the statement, "Speaking between us is forbidden if you leave," with the intention of threatening, and what is the ruling on repeating a question with doubt, and does this statement entail any Sharia prohibitions regarding pregnancy?

If a person afflicted with waswasah (obsessive whispering/doubts) reaches a point where he utters what he does not intend, then neither a divorce nor a zhihar (a pre-Islamic form of divorce by likening one's wife to a forbidden female relative) is binding upon him. This is because he is in the position of one who is insane, whose actions are not enforceable, as stated by Imam Al-Shafi'i. As for a husband who is not afflicted with waswasah, if he says to his wife, "Speaking between me and you is forbidden if you go," and he intends thereby to quarrel, then nothing is incumbent upon him.
