Is the Udhiyah accepted from a miser or from one who consumes the orphan's property?

The Udhiyah (sacrificial animal) is prescribed for the Muslim who is able to afford it, whether he is stingy or generous, just or a transgressor who commits major sins like consuming the orphan's wealth. This holds true as long as he is capable and the price of the Udhiyah is lawful, not taken from the orphan's wealth. The one who consumes the orphan's wealth must repent and return what he took to the orphan.
