Marriage is a means of tranquility and affection. If harmony and happiness are not achieved between the spouses, the wife should investigate the causes and seek remedies, and discuss with the husband to reach a solution. It is not permissible for a woman to seek divorce merely for a problem or a desire to marry a better person, because the default rule is the prohibition of seeking divorce except for a compelling reason, as the Prophet, peace and blessings be upon him, said: "Any woman who asks her husband for divorce without any compelling reason, the fragrance of Paradise will be forbidden to her." However, if the wife dislikes her husband due to his bad companionship or appearance, and cannot tolerate living with him, it is permissible for her to seek divorce, as happened with the wife of Thabit ibn Qays, who disliked remaining with her husband for fear of failing in her duties towards him. The Prophet, peace and blessings be upon him, then permitted her to seek khul'. The separation is achieved through divorce with the husband's consent, or through khul' by the wife relinquishing her dowry or part of her rights.
