What is the ruling regarding someone who swore by triple divorce—with the intent of provoking his wife—"I divorce you by three if you do not cancel your visa," while not intending to divorce her?

If you swear to cancel your wife's card without specifying a time, you fulfill your oath upon cancelling the card, and no divorce occurs, nor is expiation required of you.

However, if you intended a specific time, you violate your oath by the passage of that time without cancelling the card. In this case, your wife is irrevocably divorced with three pronouncements according to the majority of scholars. Shaykh al-Islam Ibn Taymiyyah holds that an oath of divorce not intended to effect divorce is equivalent to an oath by Allah, requiring an expiation for an oath and not resulting in divorce. When divorce is intended, he holds that pronouncing "three" divorces counts as one.

We caution that the permissible oath is by Allah Almighty, whereas swearing by divorce is among the oaths of the dissolute.
