How is the estate of a man who died and bequeathed one-third [of his property] to be divided, knowing that his heirs are a wife, eight sons, and eight daughters, and that one of the daughters is deceased and left behind a husband, a son, and a daughter?

If the deceased made a lawful will, their bequest is executed before the estate is divided among the heirs, based on the Almighty's saying: "from after any legacy that may have been bequeathed or a debt."

What remains after the will is executed, the wife takes one-eighth of it, and the remainder is divided among the sons and daughters, with the male receiving the equivalent of the share of two females, based on the Almighty's saying: "Allah instructs you concerning your children: for the male, what is equal to the share of two females," and His saying: "And for them is the fourth of what you leave if you have no child; but if you have a child, then for them is the eighth of what you leave."

As for the daughter who died before her father, she does not inherit from him; due to the non-fulfillment of the condition of inheritance, which is the heir's life after the deceased. However, if she dies after him, her share of the inheritance becomes an estate for her heirs, and her husband, son, and daughter inherit from her. The husband is given one-fourth, and the remainder is divided among the children, with the male receiving the equivalent of the share of two females, based on the Almighty's saying: "Allah instructs you concerning your children: for the male, what is equal to the share of two females," and His saying: "And for you is half of what your wives leave if they have no child; but if they have a child, then for you is a fourth of what they leave."

It is recommended to refer inheritance matters to the Sharia (definition) courts for review and investigation, as there might be an heir, bequests, debts, or other rights that take precedence over the heirs' rights.
