What is the ruling on a husband asking to return home after divorcing his pregnant wife three times in a state of anger?
If a husband divorces his wife three times, she becomes irrevocably separated from him (baynunah kubra). She does not become lawful for him again unless she marries another man out of genuine desire (marriage of desire) and he consummates the marriage with her, then he divorces her, and her waiting period (iddah) from him expires, and then he remarries her with a new contract. The husband's anger at the time of divorce does not prevent its occurrence as long as he is aware of what he is saying. If he utters the three divorces at once, some scholars, like Ibn Taymiyyah, are of the view that it counts as a single divorce. In that case, the husband retains the right to take her back during the waiting period, or after it with a new marriage contract. It is advisable to present the matter to the Sharia court or its equivalent.
