Is it permissible to return to one's husband after he has divorced her for the third time, while he is in a state of anger, drunk, and not observant of prayers?
If a husband divorces his wife with three pronouncements of divorce while he is conscious and aware, then she becomes irrevocably separated from him (Baynunah Kubra), and she is not lawful for him until she marries another man. His anger or nervousness are not taken into consideration as long as he is conscious, because divorce often occurs in a state of anger. Furthermore, there is no اعتبار (weight/consideration) to the husband's statement that he did not intend separation if he uttered a clear divorce pronouncement or a subtle one intending divorce, for a clear divorce pronouncement takes effect from one who jokes or is serious. It is not advisable to return to the husband if he is addicted to alcohol and neglects prayer, due to the risks involved in that. It is preferable in such cases to present them to the courts or to consult a directly.
