However, if the sister lives in a house she inherited from her father and it has not yet been divided, she does not have the right to exclusively benefit from it and prevent her brother; for the inheritance is a right for all heirs, and it is not permissible for any heir to monopolize residence in the inherited property without the permission of the others. Al-Jamal stated in his commentary: "The inheritance, whether cash, tangible assets, or debts, is common among the heirs, so none of them has the right to independently possess anything without a valid division." The advice for the brother is to live in his apartment and suffice with purchasing essential furniture.
