The satisfaction of the guardian (wali) and the wife are two essential conditions for the validity of a marriage contract (nikah). In the absence of these two conditions, the nikah is considered null and void, and thus unenforceable. If the girl and her father agree to the marriage, the contract must be renewed, fulfilling all the pillars and conditions of nikah. However, if the girl refuses the marriage, she cannot be forced, and this nikah does not require annulment by a judge because it was not validly concluded in the first place. Therefore, if the invalidity of the first marriage is confirmed, there is no impediment for the girl to marry another man whom her father approves and who is pleasing in his religion and conduct.
