Traffic accidents where the driver does not violate traffic laws and cannot avoid the accident are considered a waste and entail no liability for him. However, if the driver is at fault, he must offer expiation (kaffarah), which is freeing a believing slave or fasting for two consecutive months. The blood money (diyah) is to be paid by his 'aqilah (male relatives on the father's side) to the family of the deceased, unless they pardon it. Refusing the blood money may be considered a pardon and an act of charity. The difference between diyah and fidyah: Diyah is money due for an offense against a life or a limb, while fidyah is a compensation for a sharia violation or an incapacity.
