Is it permissible for a Christian girl who has recently embraced Islam to marry, by way of a "Misyar" marriage, the person who helped her convert and who will be her guardian, with the agreement that the marriage will not be consummated until Allah decrees her affair, knowing that he is already married and is thirty years her senior?

The basic principle is that the judge should solemnize the marriage of a girl whose guardians are not Muslim. However, if the girl fears the news spreading and causing discord in her faith, she should authorize a trustworthy Muslim man to marry her to the man through whom she embraced Islam, in the presence of two witnesses. If she entrusts her matter to that man to marry her to himself, there is no harm, although it is preferable to appoint an outsider to perform the marriage. There must be witnesses to the contract.

Conventional marriage and Misyaar marriage are equal in these rulings if they meet the conditions of validity. As for the agreement not to engage in sexual intercourse, if it is merely a mutual understanding, there is no harm. But if it is a condition, the preponderant view among the Hanbalis is that the condition is void, but the contract remains valid, and there is no sin if intercourse occurs at that point.
