What is the ruling on buying and selling livestock in the same place and at the same time—whether at a profit, a loss, or at the same purchase price—with a mention of the evidence?
It is not permissible to sell a sold item before taking possession of it, according to the majority of scholars. The taking possession of movable goods is by moving and transferring them from their place, and it was also said by merely vacating them. To avoid scholarly disagreement, do not sell livestock before moving them to another place. Al-Rafi'i elaborated on possession: If the sold item is in a place not specific to the seller or the buyer, then moving it to a place within it suffices for possession. If it is in a place specific to the seller, then moving it from one corner to another or from one house to another without his permission is not sufficient for the permissibility of disposal, though it suffices for it to enter his responsibility. However, if it is moved with his permission, then possession is achieved.
