Does a divorce take place if the son enters the house in the aforementioned state of anger?

1 min readAlso available in العربية

If a man conditions his wife's divorce upon their son entering the house without specifying a duration, then, according to the majority of scholars, the divorce takes effect upon the son's entry. Anger is not considered a valid excuse unless it completely overwhelms the mind and deprives one of awareness. His intention must be inquired about: did he intend a specific time, or merely a threat, or for the divorce to actually occur? If he merely intended a threat, then the divorce is not binding upon the occurrence of the suspended condition, and an expiation for breaking an oath (kaffarat yamin) suffices.
