What must the family of a man who had intercourse with his wife during a Ramadan day, and who is now deceased, do?

If the deceased leaves an estate, the heirs must feed sixty poor people. If they do not leave an estate, it is recommended for them to do so, but not obligatory. It is recommended to strive in seeking forgiveness for the deceased, and one of them may fast on their behalf for two consecutive months, based on Aishah’s hadith: "Whoever dies owing fasts, their guardian should fast on their behalf." The fasting must be done by one person due to the condition of consecutive fasting.

As for expiation for Zihar (a form of divorce) and similar matters, the heirs cannot divide the fasting among themselves because of the condition of consecutiveness. Rather, one of them must fast on behalf of the deceased, or they should feed one poor person for each day.

If the wife was obedient, she must fast for two consecutive months. If she is unable to, she should feed sixty poor people. If she has died, her guardians must feed sixty poor people on her behalf, or one of them may fast on her behalf.
