Is it established that Aisha (may Allah be pleased with her) possessed jewelry for which she did not pay zakat?
Malik narrated in Al-Muwatta' that Aisha did not pay zakat on the jewelry that belonged to her brother's orphans. Al-Baji mentioned that Aisha believed zakat was not obligatory on jewelry, and this is the view of Malik and Al-Shafi'i, whereas Abu Hanifa held it to be obligatory. The proof of the Malikis and Shafi'is is that jewelry is used for permissible adornment, so zakat is not obligatory on it, just like clothing. Al-Athram reported that five companions: Anas ibn Malik, Jabir, Ibn Umar, Aisha, and Asma', did not consider zakat obligatory on jewelry. As for the hadith narrated by Abu Dawud from Aisha regarding her asking the Prophet, peace and blessings be upon him, about the zakat on "al-fatkhat" (finger-rings), Al-Bayhaqi said about it: "How can this statement be sound given Aisha's hadith if the mention of silver in it is preserved... for she would not contradict the Prophet, peace and blessings be upon him, in what she narrated from him, except concerning what she knew to be abrogated."
