As for rape or forced adultery, if the child is old enough for intercourse, then the prescribed punishment (hadd) is due for whoever is proven to have committed adultery with her; otherwise, not. The ultimate decision on this rests with the Islamic judge ( judge), and qisas and hudud punishments may not be carried out except with the permission of the ruler.
