Is it permissible for a couple, after numerous problems and the absence of a solution, to agree to live in the same house without speaking or the husband demanding his rights or interfering in his wife's affairs, in order to preserve the children and on a temporary basis, and is the husband sinful if he does not advise his wife during this period if she commits a transgression?

It is permissible for spouses to reconcile and waive some rights if they do not fully agree in their marital life, while the wife remains under the husband’s authority, in accordance with the Almighty’s saying: (And if a woman fears from her husband disloyalty or desertion, there is no sin upon them if they make terms of settlement between them – and settlement is best).

However, refraining from speaking to the other is not permissible, because it is a blameworthy abandonment in Islamic law, as the Prophet (peace be upon him) said: (It is not permissible for a Muslim to abandon his brother for more than three nights). If they are compelled, they should limit themselves to greetings and cooperation on matters concerning their children.

If the wife commits a violation of Islamic law, the husband must not remain silent, for enjoining good and forbidding evil is an Islamic duty. And men are in charge of women by [right of] what Allah has given some over others and by [right of] what they spend. And righteous wives are obedient to Allah and guard in [the husband’s] absence what Allah would have them guard. If the husband fears defiance from his wife, he may admonish her, then abandon her in bed, then strike her with a non-injurious blow. If she obeys, then do not seek a way against her.

Both spouses must fear Allah and strive for reconciliation, and waive some rights to preserve the family and children, especially in exceptional circumstances.
