What is the ruling on taking the compensation amount resulting from a car accident, knowing that the repairs are costly and the car was sold for scrap?
There is no objection to taking the amount estimated by the expert mechanic to compensate for the damage to the car, as the reference in this matter is to those with expertise. The one who caused the damage must guarantee what he damaged, in addition to the decrease in the car's value due to the accident. There is no disagreement among jurists regarding guaranteeing the decrease in the value of assets due to damage, whether intentional or accidental. Therefore, the compensation includes the cost of spare parts and the decrease in the car's value due to the collision. There is no objection to keeping the car or selling it while receiving this compensation.
