Does a triple divorce take effect if the husband signs three divorce papers at once without knowledge of the Sharia rulings, and what is the possibility of him taking back his wife in this case?
Divorce occurs through writing if the husband intends it. As for signing a divorce paper, there is a difference of opinion as to whether it takes effect at all or depends on the husband's intention.
If we say that signing is like writing, then if the husband signs more than one paper with the intention of divorce by signing each paper, then three divorces occur according to the majority of scholars. However, Sheikh al-Islam Ibn Taymiyyah and those who followed him held that only one divorce occurs in this case, and this is the fatwa given.
Therefore, even if the husband intended divorce by signing each paper, only one divorce occurs, and he can reconcile with his wife if she is within her waiting period ('iddah). Otherwise, a new contract and a new dowry are required.
