Is a triple divorce effected by the statement, "By God, if I let you go to the market again, you are thrice-divorced," with the intention of threat, and without intense anger?
The Fatwa's essence: Suspending divorce upon a specific condition creates an oath according to the majority of scholars. It is not to be interpreted as a mere threat if expressed in clear terms. Thus, if you suspended a triple divorce on your wife's going to the market and intended for this condition to be specific to the month of Ramadan, the oath is constituted as such. If she does not go out until the month ends, then nothing is incumbent upon you. However, if she goes out during that month, a triple divorce occurs according to the majority of scholars. Sheikh Al-Islam Ibn Taymiyyah said: An expiation for an oath is due if divorce was not intended, and a single divorce if it was intended.
