Does a triple divorce take effect if the husband intended to frighten his wife, not to divorce her?
If a man divorces his wife using an explicit phrase like "You are divorced," the divorce takes effect, even if his intention was to threaten or joke. This is based on the Prophet Muhammad's (peace be upon him) saying: "There are three matters, serious in earnest and serious in jest: marriage, divorce, and revocation [of divorce]." As for a triple divorce pronounced in a single utterance, the majority of scholars hold that she becomes unlawful for him and does not become lawful again until she marries another husband, he consummates the marriage with her, then divorces her, and her waiting period (iddah) ends.
