Is it permissible for someone performing Hajj on behalf of a sick or deceased person to take a sum of money for the Hajj, spend from it on the expenses of Hajj and the fidyah, and then keep the remainder for himself?

If a person gives money to another to perform Hajj on his behalf due to his incapacitation, or on behalf of a deceased person, this is permissible, provided that the proxy has already performed Hajj for himself. The proxy may spend from this money for his Hajj performance and may keep what remains. However, if the money was given for him to perform Hajj and return the remainder, then he spends from it what he needs for his Hajj and returns the rest.
