ما الحديث الدال على الجلد للزاني المحصن؟

1 min readAlso available in العربية

The narration regarding the lashing of the married fornicator was reported by Imam Muslim from Ubada ibn as-Samit, may Allah be pleased with him, that the Prophet, peace and blessings be upon him, said: "The virgin fornicator with the virgin fornicator is to be lashed one hundred times and exiled for a year. The married fornicator with the married fornicator is to be lashed one hundred times and stoned."

However, the majority of scholars hold that the punishment for the married fornicator is stoning only, citing as evidence the story of al-Ghamidiyyah and Ma'iz, where the Prophet, peace and blessings be upon him, commanded their stoning and did not mention lashing.

They also cited as evidence the hadith of Abu Hurayrah in Sahih Muslim, where the Prophet, peace and blessings be upon him, ruled concerning a young man who committed fornication with a married woman, that the young man was to be lashed one hundred times and exiled for a year, and the woman was to be stoned after her confession, which confirms that the punishment for the married person is stoning.
