Is the hand of a thief to be cut off if he steals musical instruments?

There is no cutting of the hand for stealing forbidden instruments, because scholars stipulate that the stolen property necessitating cutting must be mutaqawwim (having monetary value), such as wine and pigs [whose value is annulled for Muslims]. This condition is agreed upon. Some scholars hold that there is no cutting unless the value of the musical instrument, after being broken and its forbidden use removed, reaches the nisab. This is mentioned in Manh al-Jalil and other texts. If this value reaches three dirhams, then cutting becomes obligatory.
