Is a woman's marriage valid if it takes place without her guardian, and is it permissible for her first husband to contract marriage with her after one menstrual cycle following the khulʾ, and should the first husband believe her claims regarding her second marriage, the expiration of her waiting period, and the transfer of guardianship?
If the 'iddah-observing woman travels, she has committed a grave misdeed and must repent. The guardian (wali) is a condition for the validity of marriage, according to the more preponderant opinion. The marriage officiated by a Sharia judge is valid. If the guardian refuses to marry off his daughter without a legitimate Sharia reason, she may refer the matter to a Sharia judge. It is not permissible for the wife to seek divorce or khul' without a legitimate Sharia reason. Divorce takes effect even if it occurs during a period of purity in which intercourse took place. If a revocably divorced woman seeks khul' from her husband, the khul' is valid. The 'iddah of a woman who has undergone khul' is the same as that of a divorced woman. Once the 'iddah ends, her former husband may marry her. The wife is to be believed if she is worthy of being believed.
