What is the legally incumbent maintenance upon a husband, in the event of his divorcing his wife due to her bad conduct, when it has been agreed to divorce her amicably, bearing in mind that he has paid the full Mahr (dowry) and deferred dowry, and is covering the rent for the accommodation and a monthly allowance for the two children?

Mut'ah (a compensatory gift) for a divorced woman is recommended by the majority of scholars and obligatory according to some, unless the divorce was by mutual release (ibra'). The amount of obligatory maintenance (nafaqa) for the wife during her 'iddah (waiting period) or for the children varies according to the husband's financial situation. This is left to the discretion of the Sharia judge, and the Sharia court is the authority for determining the legally obligatory maintenance.
