What is the legal duration of maintenance for a divorced wife, and does maintenance continue after her marriage to another man if she has minor children, and what is the view of the Maliki school on this?

Maintenance is obligatory for a woman irrevocably divorced as long as she is within her waiting period (iddah), because she is still considered a wife. However, if the waiting period ends without a reconciliation, then she is not entitled to maintenance or lodging.

As for a woman irrevocably divorced: 1. If she is pregnant: Maintenance and lodging are obligatory for her until she delivers her child, based on the Almighty's saying: {And if they should be pregnant, then spend on them until they deliver their burden.} 2. If she is not pregnant: She is not entitled to maintenance or clothing, based on the Prophet’s (peace be upon him) saying to Fatimah bint Qays: "There is no maintenance for you unless you are pregnant."

As for the children, their maintenance is obligatory upon their father. The amount of maintenance varies according to the father's financial status, whether affluent or in hardship, and according to the prevailing custom in each country. It remains obligatory for them as long as they are poor and unable to earn a living.
