The question

What is the Shar’i ruling regarding a wife who demands to stay at her family's home for the same duration she spends at her husband's family's home, and refuses to compromise, becoming angry when her husband rejects her request, knowing that the husband is a traveler and is weary of these disputes?

The answer

It is the wife's right to reside in a suitable, independent dwelling, and she is not obligated to obey her husband in cohabiting with any of his family members. If the wife has an independent dwelling within her husband's family home, she must obey him in staying there, and she is not permitted to move to her family's home without his permission. However, if she does not have an independent dwelling, the husband has no right to compel her to stay there, and she has the right to stay in her family's home until he provides her with an independent dwelling. It is preferable for the husband, if he is absent from his wife, to permit her to stay overnight at her family's home. Both spouses should treat each other with kindness and understanding.
