Suspending divorce on an unknown matter, whose truthfulness or falsehood is not verifiable, is an error. This is because it leaves the husband in doubt about the permissibility of his wife for him. Therefore, he is religiously commanded to separate from her. However, judicially, divorce does not occur as long as the wife denies it. The wife is responsible for what happened; if she did what the husband claimed, then the divorce has occurred. The husband's action of suspending the divorce is an error; he should have ascertained the matter through another method, such as li'an, or divorced her instead of living with doubt. Suspending divorce in this manner places the wife in extreme distress.
