What is the ruling on Musaqah?

Musaqat is the act of entrusting trees to someone who will water and tend to them until they reach full maturity, in exchange for a known share of their fruit. It is permissible by the consensus of the majority of jurists due to the need for it. The evidence for its permissibility is the Prophet's—peace and blessings be upon him—dealings with the people of Khaybar, where they would receive half of what the land produced in fruit. Also, the Ansar said to the Prophet—peace and blessings be upon him—: "You spare us the effort, and we will share the fruit with you." He said: "Yes."
