We believe that the profit should be divided equally between the capital owner and the worker, because the profit resulted from both the capital and the worker's effort. This is what Sheikh Al-Islam Ibn Taymiyyah favored, citing the ruling of Omar ibn al-Khattab and the agreement of the Companions. Thus, the right belongs to both of them and does not extend beyond them. Accordingly, half of the profit and the capital must be returned to the estate to be divided among the heirs according to their prescribed shares. As for the shares, there is no harm for you in keeping them if you have paid what is due from you and if they are permissible to own and invest money in.
