Is it permissible for a man to demand the dowry, gifts, and expenses after the annulment of a marriage contract that was not consummated, and what is the wife's share of them?
A woman divorced before consummation is entitled to half of the mahr (dowry), according to the clear text of the Holy Quran. However, if consummation has occurred, she is entitled to the full mahr. Scholars differ on the ruling concerning a valid khalwa (seclusion where consummation is possible), and whether it takes the ruling of actual consummation or not. If the wife enables her husband to consummate, she is entitled to maintenance, the estimation of which is referred to the judge. If gifts were presented as part of the mahr, they take its ruling; but if they were mere gifts and presents, they become her property upon possession with the giver's permission.
