Is it permissible to marry without paying the dowry if the wife’s guardian insists on not taking it, and is the dowry a condition for the validity of the marriage Islamically?

The dowry is not a condition or a pillar of marriage according to the majority of jurists, and the contract is valid without it. It is a right of the woman that no one is allowed to waive except with her consent, and she has the right to demand it or waive it entirely or partially. Its payment may be deferred by agreement. Jurists differed regarding the responsibility for furnishing the marital home. While the Shafi'is and Hanbalis do not compel the woman to provide furnishings, the Hanafis believe that if the wife is escorted to her husband's home without appropriate furnishings, the husband may demand them from her father. The Malikis hold that the woman is obligated to provide furnishings if she receives her dowry before consummation.
