Is the sin incurred by the mufti or the mustafti when there is a difference in fatwas from various bodies regarding the permissibility of wearing wide trousers with a blouse that covers half the thigh, especially given the existence of a fatwa from Al-Azhar Al-Sharif allowing the adoption of either fatwa?

Wearing trousers for women is permissible if they meet the conditions of ستر (covering), which are: that they be wide, not describing the body, nor transparent, and that a covering garment be worn over them, reaching to the knees or below. The prohibition of wearing trousers alone is due to their not fulfilling the required ستر, or because they predominantly lack one of the conditions of حجاب (veil).

Sheikh Ibn Baz and Dr. Salah Al-Sawy have issued fatwas permitting it with the aforementioned stipulations, while emphasizing that the حجاب (veil) is not a specific form but a set of conditions: that it be covering, neither transparent nor describing the body, not a garment of fame, not resembling men or immoral women, that it be appropriate for custom, and not attention-grabbing.

If the مفتون (issuers of fatwas) differ, and the مستفتي (inquirer) is not qualified to make a judgment, it is permissible for them to follow whomever they wish among them, and it is preferable to choose the more cautious opinion.
