What is the Shariah ruling for a woman accused by her husband of speaking with a non-mahram man over the phone, and he claimed to have divorced her thrice if she repeated the act? Conditional divorce, according to the majority of scholars, occurs if the condition upon which it was suspended is met, and this is the most preponderant opinion. In such cases, reference is made to the husband's intention. If he intended to suspend the divorce on his wife speaking with non-mahram (definition) men and she did not speak, then the divorce has not occurred. However, if he intended to suspend it on merely reverting to the same behavior and attempting contact, then the divorce has occurred. If he suspended it with the phrase "divorced by three" and the divorce occurred, then she is forbidden to him, and he does not have the right to take her back. She is not permissible to him until she marries another husband. It is advisable to refer the matter to a Sharia (definition) court for a ruling. In the event that the triple divorce has not occurred, efforts should be made to reconcile between them, and the wife should return to her husband if the divorce was less than three, along with advising the wife to repent. There is no harm in the husband's desire to marry another woman.
